TERMS AND CONDITIONS OF TOURISM SERVICES
At TOUR IN PERU, we are committed to providing you with a safe, transparent, and well-organized travel experience. This document sets forth the Terms and Conditions applicable to the contracting of our tourism services.
By confirming the final itinerary in writing and/or making any payment, the client declares that they have read, understood, and accepted these Terms and Conditions.
1. DEFINITIONS
TOUR IN PERU / TIP / the company: TOUR IN PERU E.I.R.L.
Client / Contracting Party: the person who makes the reservation and completes the payment.
Travelers / Passengers: participants in the trip, including companions (children, adults).
Services: travel packages, tours, hikes/treks, transfers, accommodation, trains, tickets, guides, entrance tickets, air/ground transportation, and other services included in the final itinerary.
Final Itinerary / Booking Confirmation: document (Confirmation Form) issued by TIP detailing services, dates, schedules, and specific conditions.
Third-Party Providers: external companies (hotels, train operators, airlines, restaurants, partner operators, etc.).
2. SCOPE AND VALIDATION OF THE CONTRACT
2.1. The contract is considered confirmed once the following 4 steps have been completed:
a) TIP receives the passenger’s required information for booking, and
b) TIP receives the initial payment, and
c) TIP sends the Booking Confirmation via email or agreed communication channel, and
d) TIP receives the Client’s Approval Confirmation of the final agreed itinerary or service.
2.2. In case of discrepancy between this document and the Booking Confirmation, the Booking Confirmation shall prevail (as it constitutes the final specific agreement of the service).
3. HANDLING OF PASSENGER INFORMATION (Right to Personal Data Confidentiality)
To process reservations, TIP will request necessary information to issue tickets and coordinate services. This information will be treated as confidential (more information here) and used exclusively for travel operation purposes:
- Full name (exactly as shown on passport or national ID).
- Date of birth.
- Nationality.
- Passport or ID number.
- Dietary restrictions.
- Relevant medical condition (mandatory for adventure tours/treks).
- Passport copy (if the passport is close to expiration, the updated version must be sent once available).
TIP may share strictly necessary information with Third-Party Providers solely for service execution (hotels, trains, ticket issuance, permits, etc.).
4. PAYMENTS, DEPOSITS, AND PAYMENT METHODS
4.1. Initial Payment (Deposit)
To confirm a Travel Package / Tour / Service, a deposit is required. The percentage or amount will depend on the type of service and pre-purchase requirements (tickets, trains, hotels, permits). As a general rule:
- 100% for Travel Packages / Tours starting within the next 15 days.
- 50% for Travel Packages / Tours starting more than 15 days in advance.
- 30% for Travel Packages / Tours starting more than 90 days in advance.
- 100% for high-demand services requiring advance reservation and purchase (separate from the tour rate), such as (airline tickets, permits, entrance tickets, train tickets). These are NON-refundable.
The deposit covers administrative management, booking expenses, payment processing commissions, and pre-purchases. Therefore, it may not always be 100% refundable (see Section 8).
4.2. Payment Methods
- Credit card payment (website or payment link).
- Niubiz / We Travel / PayPal.
- Bank transfer.
- Western Union / MoneyGram.
- For Peruvian residents (Yape / Plin / Bank transfers / etc.)
Commissions: Fees charged by payment gateways or banks are borne by the client and are non-refundable.
4.3. Currency and Pricing
Rates for foreign clients are in USD and for Peruvian clients in Peruvian Soles (PEN) or USD.
Unless otherwise indicated, rates are expressed in USD. Prices may vary due to external factors (exchange rates, supplier pricing changes, availability, seasonal adjustments, regulatory changes).
5. BALANCE PAYMENT
The remaining balance must be paid prior to service commencement, as specified in the Booking Confirmation.
Payments must be made via credit card or authorized digital methods.
- For 50% deposits: the remaining balance must be paid within 10 days prior to the tour start date.
- For 70% deposits: the second payment equivalent to 35% is due within 60 days prior to the tour start date, and the final 35% within 10 days prior to departure.
Important: If the balance is not paid within the specified deadline, TIP may cancel the reservation applying penalties in accordance with Section 8.
NOTE: If payment is made in cash in SOLES or USD (DAMAGED BANKNOTES ARE NOT ACCEPTED: stains, marks, tears; USD bills from the CBB2 series are not accepted).
6. AIR TICKETS, TRAIN TICKETS, ENTRANCE FEES, AND PERMITS
6.1. In general, airline tickets, train tickets, entrance tickets, and permits (Inca Trail, Machu Picchu, or others) are non-refundable, non-transferable, and non-modifiable, as they are subject to strict supplier or authority policies.
6.2. TIP does not control these policies. Any refund or modification will depend on the amount effectively recoverable from the supplier (see Section 8).
7. CLIENT-REQUESTED MODIFICATIONS
All itinerary modifications are subject to AVAILABILITY and RATE ADJUSTMENTS.
7.1. Before confirmation (before deposit): changes without penalty, subject to availability and price adjustments.
7.2. After confirmation (with deposit/payments):
- Administrative management fees + rate differences + third-party penalties may apply.
- For permits, entrance tickets, and trains, changes may not be allowed or may carry full penalty.
- For date changes, applicable penalties will apply to tickets/entrances already purchased in advance; these are subject to availability and new purchase payments for reissuance.
7.3. Change of passenger name: For nominative services (Inca Trail / Machu Picchu / trains, etc.), name changes are NOT permitted.
8. CANCELLATIONS, PENALTIES, REFUNDS, AND CREDITS
TIP prioritizes flexible solutions but must comply with supplier, permit, and ticket policies.
8.1. Base refund calculation principle
Refund = Total amount paid to date – (Non-refundable commissions + TIP administrative penalty + Non-recoverable third-party components)
Third-party components may include (among others): train tickets, entrance tickets, permits, hotels, flights, prepaid services, etc.
8.2. Client cancellation
Unless the Booking Confirmation indicates a different rule due to a special service:
- More than 30 days prior to the tour start date, TIP refunds the recoverable amount applying the formula.
- Between 29 and 15 days prior, TIP refunds 50% of the recoverable amount applying the formula.
- Between 14 days and the tour start date, NO refunds apply.
- NO SHOWS: no refunds apply.
In all cases, TIP will provide the client with an explanation of the non-recoverable amount when applicable.
8.3. Special policy: Inca Trail and high-demand services
Please review “Annex A”
8.4. Preferred alternative: rescheduling credit
Instead of canceling, the client may request:
A credit/voucher applicable to a new date (reference validity 12 months), subject to:
- availability,
- rate differences,
- third-party penalties that may prevent rescheduling,
- administrative management costs.
9. SERVICE PROVIDER CANCELLATION / RESCHEDULING
9.1.If events occur beyond TIP’s control (CLIMATIC/NATURAL PHENOMENA, POLITICAL ACTIVITIES, PROTESTS, EARTHQUAKES, EPIDEMICS/PANDEMICS, CONSTRUCTION/MAINTENANCE WORKS, etc.), TIP may:
- reschedule (minor cases),
- partially or fully cancel (major cases),
- offer an equivalent alternative route,
- adjust the order of the itinerary,
- or process refunds only for the recoverable portion.
9.2.TIP is not responsible for personal traveler expenses resulting from these events (personal purchases, extra nights, non-included meals, missed direct flights and/or connections —domestic or international—, others). Therefore, TIP recommends travel insurance.
10. TRAVELER RESPONSIBILITIES
The traveler agrees to:
- Provide truthful information for reservations.
- Carry the passport/document used in the booking.
- Comply with schedules (punctuality) and safety recommendations.
- Respect cultural and environmental rules and the guide’s instructions.
- Inform of any incident or discomfort (health and/or inconvenience). Likewise, if there is any location change (hotel changes, arrival and departure schedules) for prevention purposes and to avoid affecting scheduled activities.
- Care for and return equipment provided or loaned for the activities to be performed such as (trekking poles, tents/camping gear, etc.).
- In case of loss or damage to equipment, the degree of responsibility will be evaluated to apply a charge according to the equipment.
- Each passenger is responsible for safeguarding their valuables such as: cash, technological items, jewelry, clothing, cell phones, etc. that the client considers very important.
- TIP is not responsible for loss or misplacement of such items; TIP will provide all support to resolve the incident.
10.1. Medical condition and safety
For treks/adventure services, the traveler must be in adequate physical condition.
TIP may request a medical certificate in case of risk (e.g., travelers over 65, or relevant pre-existing conditions).
If the traveler is under the influence of alcohol/drugs, or exhibits dangerous behavior, TIP may suspend the service for safety, without refund.
10.2. Voluntary abandonment
If the traveler decides not to continue a service already started by their own choice, no refund applies for the unused portion (unless the third-party provider grants recovery).
If the decision to ABANDON is made en route, outside the starting point (pickup point/hotel), the TIP service provider is not obligated to cover the return of the passenger(s).
11. TRAVEL INSURANCE
It is recommended that every traveler purchase travel insurance for all services.
Mandatory for adventure activities and treks (medical coverage, evacuation, cancellations/delays where applicable, and altitude coverage where applicable).
For pre-existing conditions, the traveler must travel with proper evaluation and medication.
12. THIRD-PARTY PROVIDERS
Third-party providers operate under their own policies. TIP acts as organizer/manager of the itinerary and coordinates reservations, but does not control third-party operational decisions (schedule changes, cancellations, etc.). TIP will provide reasonable assistance to resolve incidents.
Within third-party providers we have (airlines/flight tickets, railway companies/ground transportation, restaurants, hotels, entrance tickets to attractions managed by public or private entities).
13. CLAIMS AND OFFICIAL COMPLAINT BOOK
If there is an incident, the client must communicate immediately so that solutions can be applied during operations. In Peru, complaints can be registered in the Libro de Reclamaciones (in office or through an enabled channel).
14. GOVERNING LAW AND JURISDICTION
This document is governed by the laws of Peru. Any dispute shall be resolved before the competent courts of the city of Cusco.
15. DOCUMENT MODIFICATIONS
TIP may update these Terms and Conditions due to regulatory, operational, or supplier changes. The valid version shall be the one published on its official channels, with no retroactive effect for bookings already confirmed.
16. ANNEX A – SPECIAL CONDITIONS: INCA TRAIL AND SIMILAR TREKS
(Applies to: Inca Trail, Salkantay, Lares, Choquequirao, Inca Jungle, Waqrapukara, Rainbow Mountain, Humantay Lake, and any trekking or adventure activity in mountains or nature.)
16.1 Nature of Permits and Official Quotas
The Inca Trail to Machu Picchu is regulated by the Ministry of Culture of Peru (State authority).
The permits:
- Are nominative (issued in the passenger’s name).
- Are non-transferable.
- Are non-modifiable in name, date, or passport number.
- Have limited daily quotas.
- Once issued, they are 100% non-refundable, since payment is made directly to the competent authority.
In the case of other treks or alternative routes, even if there is no nominative state permit, there may be limited quotas, advance logistical reservations, and non-recoverable operational commitments.
16.2 Payment and Confirmation
To secure a space on the Inca Trail or any similar trekking activity:
- An initial deposit is required (as per Section 4.1).
This deposit covers:
- Official permits (when applicable).
- Administrative expenses.
- Logistical reservation (transportation, meals, staff, campsites, equipment, etc.).
The reservation is only considered confirmed when:
- Correct passport details are received.
- The required payment is made.
- The Booking Confirmation is issued by TOUR IN PERU.
16.3 Cancellations – Inca Trail and Treks
16.3.1 Client cancellation
The official Inca Trail permit is 100% non-refundable.
For other treks, non-recoverable prepaid services cannot be refunded.
Other components (hotel, train, transportation, etc.) will be evaluated in accordance with Section 8 of the General Terms.
The refund, if applicable, will be calculated on the recoverable amount (according to the formula).
If the third-party provider does not issue any refund, TOUR IN PERU cannot refund that component of the service.
Important: If the client has only paid one of the deposits (partial payment) and, prior to cancellation, TOUR IN PERU has already made payments or confirmed non-refundable services with third parties, the client must cover the total committed costs, even if these exceed the deposit paid.
16.4 No Show (Failure to Appear)
If the client does not appear on the tour/trek start date:
- It will be considered a NO SHOW.
- No refund applies.
16.5 Date Changes or Transfer of Service
In the case of the Inca Trail:
- Name changes are not allowed.
- Date changes are not allowed.
- Transfer of the service is not allowed.
For alternative treks, changes are subject to availability and operational penalties.
16.6 Inherent Risks and Participation
The client acknowledges that these activities involve:
- High altitude.
- Significant physical exertion.
- Variable climate.
- Irregular terrain.
- Natural risks inherent to Peru’s geography.
The client participates at their own responsibility.
16.7 Physical Condition and Mandatory Insurance
The passenger declares:
- They are in adequate physical condition.
- They will inform dietary and medical restrictions.
- They will declare pre-existing illnesses.
It is mandatory to have insurance covering:
- Evacuation.
- Medical expenses.
- Accidents.
- Health problems related to altitude.
- Costs arising from emergencies.
Travelers over 60 years old may require a medical certificate.
16.8 Suspensions and Safety Sanctions
TOUR IN PERU may temporarily or permanently suspend participation if the passenger:
- Is under the influence of alcohol or drugs.
- Shows risky behavior.
- Does not follow the guide’s instructions.
- Expresses racial, gender, religious, or physical discrimination.
In these cases, no refund applies.
16.9 Limitation of Responsibility – Risk Activities
The passenger accepts that they may have no prior experience in activities such as:
Horseback riding, use of motorcycles and ATVs, Zip Line, rock climbing, mountain hiking, canoeing, or other adventure activities.
TOUR IN PERU will provide a prior informational briefing in accordance with Article 12 of the Safety Regulation for the Provision of Adventure Tourism Services (Supreme Decree D.S. N° 005-2016-MINCETUR).
TIP guarantees the safety of its clients by employing highly qualified professionals to prevent accidents, illnesses, and loss of property.
TIP is not responsible for accidents that occur despite such risk warning.
16.10 Voluntary Abandonment
If the client abandons the tour by their own decision:
- The unused portion is not refunded.
- Additional costs will be assumed by the client.
17. ANNEX B – SPECIAL CONDITIONS: MACHU PICCHU, TICKETS, MULTI-SERVICE TRAVEL, AND NATIONAL PROGRAMS
(Applies to packages across Peru’s Coast, Highlands, and Jungle: Lima, Paracas, Ica, Nazca, Arequipa, Colca, Puno, Lake Titicaca, Amazonas, Northern Peru, among others.)
17.1 Machu Picchu Entrance Tickets
Entrance tickets:
- Are nominative.
- Are issued with the passenger’s name and passport number.
- Are subject to daily availability.
Once issued:
- They are non-refundable.
- They do not allow name changes.
- They do not allow date changes.
17.2 Train Tickets
- Are nominative.
- Are subject to the railway operator’s policies.
- Are normally non-refundable.
- Have penalties for changes.
- Do not allow transfer.
Refunds depend on the amount effectively recovered from the supplier.
17.3 Air Tickets
They are governed by the airline’s policies.
They are NON-refundable.
Changes imply penalties and fare differences.
TOUR IN PERU does not control airline policies.
17.4 Nature of Multi-Service Travel
In packages that include: hotels, ground transportation, cultural tours, internal flights, gastronomic experiences.
TOUR IN PERU acts as organizer and coordinator of multiple services offered by third parties, each with independent policies.
17.5 Payments and Commitments with Suppliers
Once TOUR IN PERU has made non-refundable payments to third parties, those amounts cannot be recovered.
If the third-party provider does not issue any refund, TOUR IN PERU cannot refund that component.
17.6 Changes
Changes after confirmation may involve:
- Administrative penalty.
- Fare difference.
- Hotel or supplier penalty.
17.7 Cancellations
Refunds will be based on:
- The amount effectively recoverable.
- Each supplier’s policies.
- Administrative management penalty.
17.8 Force Majeure
In case of: strikes, blockades, state emergencies, extreme weather, authority decisions; TOUR IN PERU may:
- Reschedule.
- Offer an equivalent alternative.
- Adjust the itinerary.
- Process refunds of the recoverable amount.
Personal expenses arising from such events are not assumed.
